ADMINISTRATION CHARGE: Transactions not picked up or canceled by the sender within one year of the send date will be assessed a non-refundable administration charge of up to fifty cents (CAD) per month from the send date, not to exceed forty-two dollars (CAD). The charge will be deducted from the amount sent. All administration charges include applicable taxes - 5% GST, 9.975% QST, or 13% HST - depending on the province from where the money transfer originated.

REFUNDS: Two types of refunds are outlined in the terms:

• PRINCIPAL REFUNDS and cancellation of the money transfer will be made if payment has not been made when Western Union processes the written request from the sender. If the Receiver rejects the funds or if the sender requests a refund, Western Union may charge a fee to refund the principal amount back to the sender.
• TRANSFER FEE REFUNDS may be made if funds are not available within the specified timeframe. Qualifying refunds will be processed within 45 days of receipt of a valid written request from the sender.

RESOLUTION OF DISPUTES: Except for transactions originating from Quebec, or where otherwise prohibited by applicable law, any dispute arising from or relating to the transaction shall be resolved by final and binding arbitration. The arbitration will be administered by National Arbitration and Mediation (“NAM”) under its Comprehensive Dispute Resolution Rules and Procedures. Senders are responsible for up to $125 CAD of the administration fees. Western Union may reduce this amount if the sender demonstrates hardship. Class actions or arbitrations are not permitted, and if any part of this arbitration provision is found to be invalid, it shall not invalidate the other parts.

LIMITATIONS OF LIABILITY: Western Union's liability is limited as follows:

• To the sum of $500 (CAD), beyond refunding the transaction amount and transfer fees, except for transactions originating from Quebec or where otherwise prohibited by law.
• Western Union and its agents will not be liable for indirect, special, incidental, consequential, exemplary, or punitive damages, or the like.

CURRENCY EXCHANGE, INTERNATIONAL SERVICES: Currency conversion rates will apply to the transaction. The rate provided by Western Union for converting Canadian currency to foreign currency may differ from the rate received by Western Union. Any difference between the rates will be kept by Western Union and its agents, in addition to the transfer fees.

IDENTITY AND LOCATION VERIFICATION: Western Union is authorized to request mobile carrier assistance to use sender's mobile subscriber details for verifying their identity. This information may include name, billing address, email, phone number, and location information, if available.

GENERAL: The Agreement cannot be modified orally and is governed by Ontario law, without regard to conflicts of law rules. If the transaction is from Quebec, the laws of Quebec will apply.
